This Privacy Policy explains how we collect and use the personal information that you provide online to our websites (the “Sites”), our products, or any program run by Empower.

Please read this policy before submitting any data to us.  By using our Sites or sending us data, you consent to the collection and use of your personal information as outlined in this Privacy Policy.  If you do not agree, you should refrain from using our Sites and products.

Personal Information We Collect

In General

We may collect and store any personal information you enter on our Sites or provide to us in some other manner. Personal information is data that identifies you, or that can be combined with other information to identify or contact you, and includes (but is not limited to) your name, business or personal email address, job title, organization, organization’s physical address, direct telephone number, photograph, and biographical details. In some cases, biometric data is also stored.  You are not obligated to provide us with any personal information, although you may need to provide some information to be provided additional information from our Sites or for our products to be used. We strive to limit the type of personal information that we collect to information that helps us accomplish our goal of providing great services.

Our Products

The nature of our software is to process human resource information so people will be accurately and timely engaged with their employer.  This includes, but is not limited to, proper working hours tracking, time off accumulation and tracking, payroll, tax, on-boarding, and talent management.  This data is supplied by our clients, who retain ownership of this information.

Information from Other Sources

We also may periodically obtain both personal and non-personal information about you from other sources. Examples of information we may receive include updated contact information and additional demographic information. Please note that Empower may have previously collected personal information relating to you at the time you or your organization became a client.

Information Collected Automatically

When you visit our Sites and our products, we automatically collect and analyze certain information about your computer. This information includes, but may not be limited to, the IP address used to connect your computer to the Internet, information about your browser type and language, the date and time you are accessing our Site, the content of any undeleted cookies that your browser previously accepted from us, and the referring website address.

Use of Cookies and Other Technologies

We may use (or may contract with service providers to use) various technologies to collect information about your activities on our Sites.

  • Cookies. When you visit our Sites and products, we may assign your computer one or more “cookies.” A cookie is a small text file that contains information that can later be read by us to facilitate your access to our Sites and personalize your online experience. Also, through the use of a cookie, we may automatically collect information about your online activity on our Sites, such as the web pages you visit, the links you click, and the searches you conduct. Most browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies by visiting the Help portion of your browser’s toolbar. If you choose to decline cookies, please note that you may not be able to sign in or use some of the interactive features offered on our Sites and products.
  • Other Technologies. We may use standard Internet technology, such as Web beacons (also called clear GIFs or pixel tags), locally stored objects (often referred to as “flash cookies”), and other similar technologies to deliver or communicate with cookies and track your use of our Sites and content presented via the Sites. We also may include Web beacons in e-mail messages or newsletters to determine whether messages have been opened and acted upon. The information we obtain in this manner enables us to customize the services we offer and measure the overall effectiveness of our online content, advertising campaigns, and the products and services we offer through the Sites.
  • Information Collected by Third Parties. Third parties, such as vendors, advertising entities, and business partners, may use cookies and other technologies (such as Web beacons) to collect information about your online activities. The purposes for collecting this information is to measure usage of our Sites. We do not have access to or control over cookies or other features these third parties may use, and the information practices of these third parties are not covered by this Privacy Policy.

How We Use the Information We Collect

In General

We use the information we collect about you for the following purposes:

  • To respond to inquiries that you submit to us via the online “contact us” feature and determine which products and services will help you achieve your business goals
  • To send you information about our products and services that you have requested from us
  • To communicate with you about surveys, marketing, promotions, events, educational forums, and other opportunities offered by Empower and its partners, including information about other products in which you may be interested
  • For the purpose stated on the form or page where you provide the information
  • To generate aggregate and anonymous reporting
  • To ensure the functioning of our Sites

Products / Client Data

Data given to Empower by automation, manual import, or use of our products will be used for the following purposes:

  • To provide the product functionality and services you or your employer have purchased
  • To troubleshoot issues with our products and services
  • To test new product functionality for issues, accuracy, and performance

Choices about the Use of Your Information

Empower feels it is important that you have the opportunity to choose how your data is collected and used.  We will not use your personal information for any purpose other than those described in this Privacy Policy without first obtaining explicit consent to do so.

Marketing Communications

Occasionally, we will send you marketing communications we hope you will find valuable.  These may be offers on products, invitations to events, or information about partnerships.  We will remove you from receiving these communications if you wish by selecting the unsubscribe link at the bottom of each email.  We will not share your information for use by third parties to market to you about their products and services without your explicit consent.  Client databases and personal information stored within our products is never used for marketing purposes.

Client Communications

Clients will receive service notices and other critical production information regardless of marketing communication preferences.  These include, but are not limited to, planned maintenance notifications, upgrade options, regulatory notices, etc.  Please contact Empower to change your company contacts for these types of communications.

Disclosures of Personal Information

Empower may share your information with third parties in the following instances:

  • We engage service providers and third-party agents to process personal information on our behalf. Where possible, we require these service providers to implement adequate technological and organizational security and privacy measures before they can receive any personal information from us to ensure that your personal information will be appropriately protected and only used for the purposes of performing the services for us;
  • In response to subpoenas, court orders, or other legal process; to establish or exercise our legal rights; to defend against legal claims; or as otherwise required by law. In such cases we reserve the right to raise or waive any legal objection or right available to us;
  • When we believe it is appropriate to investigate, prevent, or take action regarding illegal or suspected illegal activities; to protect and defend the rights, property, or safety of Empower, our customers, and others; and in connection with our Terms of Service and other agreements;
  • In connection with a corporate transaction, such as a divestiture, merger, consolidation, or asset sale, or in the unlikely event of bankruptcy; and
  • We also may share aggregate or anonymous information with third parties, including investors and partners. Aggregate or anonymous information does not contain any personal information, and its use and disclosure is not subject to the terms of this Privacy Policy.

Access and Correction of Personal Information

Clients have access to their data at all times through our products.  Individuals with issues or concerns with personal HR data held by Empower should contact their employer to request access or changes to their information.

Information Security

We have implemented reasonable technical and organizational security measures to help protect against unauthorized access to or unauthorized alteration, disclosure, or destruction of personal information. Unfortunately, no data transmission over the Internet can be guaranteed to be entirely secure, and we assume no liability for any damage suffered by you caused by the interception, alteration, or misuse of information during transmission.

We make reasonable efforts to restrict access to personal information to employees, contractors, and agents who need to know that information in order to operate, develop, or improve our products and services.

Please note that the effective security with respect to our products depends, in part, on you ensuring that any IDs and passwords that you have been issued by us or your application managers are kept confidential and secure and that you adhere to the restrictions on password and ID-sharing set forth in our Terms of Service.

For credit card transactions, we offer the use of a secure server. All supplied sensitive/credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our Payment gateway providers’ database only to be accessible by those authorized with special access rights to such systems, and are required to keep the information confidential.

After a transaction, your private information (credit cards, financials, etc.) will not be stored on our servers.

International Transfers of Personal Information

Empower operates and hosts all our Sites and products in the United States.  Any submission or data transfer to our servers from another country will transfer that data into the United States.  We do not transfer this data out of the US, nor do our partners, unless a client explicitly requests the transfer.  You should be aware that privacy laws in the United States may not provide protections equivalent to those of your country of residence, however Empower strives to ensure appropriate levels of protection and privacy to ensure the security and quality of your personal information.  Your data is only processed in accordance with this Privacy Policy.

Safe Harbor

We comply with the US-EU Safe Harbor Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information from European Union member countries, and have certified that we adhere to the Safe Harbor Privacy Principles. We agree that any disputes regarding our privacy policies and related actions regarding data from Europe can be heard by the European Data Protection Authorities, and we will be subject to the determinations of those bodies. Any complaints about our adherence to the practices described in this Privacy Policy or non-compliance with the Safe Harbor Principles should first be addressed to Empower’s Privacy & Data Protection Officer at privacy@EmpowerSoftware.com. Because we value your privacy, we have taken the necessary precautions to be in compliance with the California Online Privacy Protection Act. We, therefore, will not distribute your personal information to outside parties without your consent.

Childrens Online Privacy Protection Act Compliance

We are in compliance with the requirements of the Children’s Online Privacy Protection Act, and do not collect any information from anyone under 13 years of age. Our Sites, products, and services are all directed to people who are at least 13 years old or older.
